Car Insurance Claim

I am Gurinder Singh from Jalandhar Punjab, I bought a Hyundai Getz car 2005 model from Cargo Motors Jalandhar in 28 Sep 2009 and same day i paid all the amount of car via cheque and i the car was financed from ICICI and i asked for the NOC and i have been told u will get in 10 days. I took car same day and waiting for the NOC which i need for the transfer for RC but i didnt get on time which they commit me and i asked them for many times but they make excuses everytime, in the meanwhile i met with major accident on 16 Nov 2009 and there is no casualty or no any public property loss. I went to garage and i launch a claim. Due to non availability of NOC company rejected the claim they said the car was resaled and that should be transferred to the buyer in 30 days from the date of resale, Cargo motors didnt give me the NOC on time thats why I cant transfer the RC on my name, i launched the Case against insurance company and Cargo motors. Cargo Motors gave me the NOC on 15 Dec 2009 after the accident and car repair took 2 months and Hyundai company repaired the car with the permission of Insurance company. Now I received a letter from Court that u can not claim and only the registered owner can claim to Insurance company I had transfer the RC in Feb 2010. Plz suggest me what should i do now
