Google, Facebook Petition: Delhi HC Will Hear Arguments on Jan-19

India Legal News: Clearly not impressed with arguments presented before the honorable Delhi HC made by counsels representing Google and Facebook and 19 other social networking sites on hosting ‘user generated’ anti-religious and/or anti-social content on their platforms, the next round of hearing has been scheduled to 19th January, 2012.
Hearing petitions of social networking site, Google India’s lawyer, advocate Neeraj Kishan Kaul reportedly countered the Delhi HC’s previous stand on blocking websites like the Chinese have done if objectionable content was not removed. He said, "The issue relates to a constitutional issue of freedom of speech and expression and suppressing it was not possible as the right to freedom of speech in democratic India separates us from a totalitarian regime like China."
Predominantly a global system, the internet has little or no control on what users post. 99% of Google’s, which essentially is a search engine derives revenue from advertising.
Acting on a complaint filed by a journalist, the lower court intends to prosecute Google, Facebook and 19 other internet based corporations to remove controversial content from its pages else would be banned in India.
Countering one of the arguments that a landlord is not responsible for what the tenant does, the civil judge retorted, "Are you not a beneficiary of Google Inc's business? If some illegal activity is being carried out by a tenant and the landlord is a beneficiary, then how can the landlord not know what's happening?"
