Hit and run case

Dear sir,
my father was crossing the road and a person riding honda activa hit him.... both of them fell down but the convict managed to away but we have noted down the vehicle number....we have already lodged a fir but no action has been taken yet..... The person owning that vehicle is not ready to accept that ....and not ready to give full compensation..... We have spent more than Rs 80000 on medical..... His vehicle was not insured and the vehicle owner is not ready to tell who was riding his scooter .....please suggest.......plz help...

Since the FIR has been lodged in your case and the police is not doing the needful, you can file an application under section 156(3) Cr.Pc with the Judicial Magistrate of first class and he could direct the police to carry the investigation in accordance with the law. Simultaneously you may also file a case for compensation with the Motor Accident Claims Tribunal. If their was no third party insurance then the vehicle owner would be liable to pay the compensation.
