India Legal News: Army Women Officers to be granted Permanent Commissions
As per India legal news reports, the women army officers have won the legal spat with the government of India. The government of India has assured the apex court that it will consider granting permanent commission (PC) to women army officers, in legal and educational departments. However, the women officers seeking PC, from other branches of army, such as combat and infantry, will have to wait.
India Legal News: Government Will Consider Women Officers for PC
As per India legal news reports, the government of India has finally submitted an undertaking that women serving officers of Short Service Commission, in the Judge Advocate General (JAG) and educational departments of the army, will be considered for Permanent Commissions. This undertaking requires the issue to be resolved within a period of two months.
The undertaking was submitted by the Solicitor General of India, Gopal Subramanium, to a Bench comprising of Justices J.M. Panchal and Gyan Sudha Mishra. The undertaking was recorded by the Bench. Following this, the apex court put a stay on the contempt of court proceedings against the army, till further orders. The army was facing contempt of court charges, for not adhering with the Delhi High Court orders, to grant PC to women army officers.
Further, the court directed the government to file an affidavit, explaining the nature of task assigned, to the officers receiving PC. Also, the court said that it will further examine the matter, after the details are submitted, by the Army.
The official report of the Defence ministry indicates that there are nearly 2, 200 total women officers in the armed forces, including 1, 200 army officers, 750 airforce officers and 250 naval officers.
IAF has earned applauds from public as well as honourable court by implementing the court order of granting permanent commission to women officers but no one knew at that time that injustice is being done to some of the women officers who were never given any chance to express their willing ness.
IAF has beautifully twisted the wordings of Honourable court by stating that "PC would be granted to only those women officers who have ever opted for PC before 12 Mar 2010 and to those who have approached the court.It will not be granted to all women officers who are still serving and inducted before 2006."This is something rediculous.I think our defence services are behaving in a senseless manner and may be these women officers have to prove their strength once again by knocking the doors of honourable court.
Defense services are not only loosing out on highly trained and motivated officers especially when there is a shortage in officer cadre but also tarnating the image of good organisation.
