On 12th May 2010, the Allahabad High Court held that the marriage of a Muslim man to a Hindu girl as void. The Division Bench comprising Justice Rajesh Chandra and Justice Vinod Prasad held that a Muslim man’s second marriage would be null and void when he abandons his first wife and the children, who are born from this first marriage.

Muslim Man's Marriage to Hindu Woman, Khusboo, Allahabad, high courtThe Hindu-Muslim marriage we are discussing here revolves around the marriage of the petitioner, Dilbar Habib Siddiqui with Khushboo Jaiswal (a Hindu woman), held on December 29, 2009.

The case was filed by Sunita Jaiswal, Khusboo’s mother who alleged that her daughter had been kidnapped by a Muslim man named Siddiqui, who had forced Khushboo to marry him. 

The mother stated that her daughter was a minor at the time of the marriage. Saddiqui, on the other hand, produced Khushboo’s high school certificate to prove that she was not a minor and that she had married him voluntarily.

What led to the complexity in this case was that Siddiqui already had a wife and three children. This fact had been hidden from Khushboo. During the time when the case was being heard in court, Saddiqui’s first wife appeared in court and alleged that he had abandoned her and their three children.

At this point, after hearing the parties, the court said that Khushboo had not mentioned whether she knew about Siddiqui’s first marriage or not. The marriage between Siddiqui and Khushboo was held as void. The court ordered swift investigation to be carried out pertaining to the challenged FIR based on Khushboo’s mother’s statement. The Nari Niketan authorities, where Khushboo has been kept, were directed by the court to hand her over to her parents.

Many girls run off with boys when they are madly in love, hoping to begin a happy-for-ever after type of marriage. In movies, it reaps blockbusters but in reality, such acts of impulsiveness become disasters that can ruin a girl’s life and happiness.

The Allahabad High Court Division Bench comprising the two judges quoted from a verse in the Holy Quran which says, "Do not marry unbelieving women until they believe... Nor marry your girls to unbelievers until they believe."

Final Legal Take Away Tip: This judgment poses many questions to Hindu-Muslim couples in India who plan to marry or those who are already married. A non-Muslim woman must first convert to Islam before marrying a Muslim man. In this case, the Allahabad High Court declared, "For a valid Muslim marriage, both the spouses have to be Muslim."

What I have understood from this case is that this was a case of polygamy which can only be valid under Muslim marriage law and for that both parties have to be of that faith. Quite rational.
But you also go on to mention that for a valid Muslim marriage both spouses have to be Muslims? But does it being a valid/invalid marriage effect anything other than inheritance?

Any declaration by Allahabad High Court is not effective for the entire nation. Could have been happy if it was SC of India's verdict. This is required to protect Hindu girls from the long running "Love Jihad". I believe this is no ghost, but fact. A very hard to swallow fact for Muslims though.

Till when the "same citizen rights" will not be constituted capturing Hindu girls by mislims will not be controlled. It is because like "Mulla Mulayam" type politicians who can sale anything to get vote for remain in power politics. Those who can marry their cousin sisters too what the position they will give to sisters-mothers of others????? The woman meant for them is only to children and grow their population to come in majority in the world. Capturing the girls of others is a for this purpose. Special concessions for them in constitution is made by so called politicians who are short sighted only for their short sighted interest which is throwing the India to become a muslim dominated society.

The Indian constition says "EQUAL RIGHTS FOR EVERYONE" SO WHY SUCH SPECIAL PROVISIONS FOR MUSLIMS????? It is against equility in humanity and it is thretening for others.

guys..dont misinterpret the judgment..the hindu muslim marriage is still as valid as other marriages provided they are solemnised under special marriage act. the impugned jugment of allahab was absolutel holds correct since it was in the context of NIKAH, since the couple had nikah or marriage as per muslim personnel law but not as per special marriage act...so no worries!!

Hi..i had the same case as urs n now m married to my boyfriend who indeed is a muslim. court marriage under the special marrriage act is the safest bet for u, as it doesnt ask either of u to change ur religion. one can retain his/her religion even after marriage. once the official marriage is performed under the special marriage act, then whichever ceremont one performs, be it nikah or hindu marriage by taking pheras, u still are what u were a hindu or a muslim..because the laws of the court i.e. those prescibed by special marriage act abide..thus ur husband cannot have a second marriage (as is allowed if only nikah is perfomed.) all rules of the special marriage act come into force once the court marriage is done. However, themost important is to make the court marriage be the first marriage under which u marry and then the ritualistic marriage (if nay) as the 1st marriage is the only valid marriage. hope that explains it all..by the way, i had consulted a lawyer for all these preceedings

I had a special marriage act in year 200 I am hindu and my spouse is a muslim, we then had nikah in 2002. The nikah was under a diffrent name as i had to convert for the marriage however i did not legally change my name. I continue with my hindu name. now I need a divorce from this marriage , please tell me if special marriage act provisions apply or nikah?

Hi..thanq so much for ur valuable info, Im planning to get married to a muslim guy, I was just thinking, now I trust him so much..but may be in future I may face a problem coz polygamy is legal in muslims..with the info u shared with us, Im will surely marry through court first and later wat ever it is..so that polygamy will not be valid for my to-be-husband...can I marry through aarya samaaj??? does it play the same rules as court marriage???
