The wise judge and King, Solomon, is known to have found unique ways to decide disputes that came before him. He had a knack of getting parties to a dispute to reveal their true colors without them being aware of it and he used this method to determine the truth. There is a popular story of how King Solomon was approached by two women, who were claiming right over a baby. After hearing both the women, King Solomon ordered that the baby should be cut into two pieces and both of them shall receive amn equal share. While one woman agreed to it, the other said she would give the baby away. The King understood that the latter was indeed the real mother of the baby. After all, a mother would rather give away her baby than let any harm happen.
Indian Law: Qualities of a Good Judge
For fair judgment and effective enforcement of Indian law, the country required competent and experienced judges, who have expertise in their respective domains. A judge is expected to possess following qualities in order to settle a dispute fairly:
- Honesty.
- Impeccable reputation.
- Integrity and humane approach.
- Sound and logical judgment.
- Hunger for knowledge.
- Ability to bridge the gap between common man and justice.
- Uphold and interpret Indian laws in accordance with the legislative intent.
However, a corrupt and incompetent judge may pose danger to the judicial system. He will not be able to decide cases efficiently. His inability to interpret the law and application of law to cases would not inspire trust in people or within the legal fraternity itself. It could further delay delivery of justice and would cause perpetual worry, because an incompetent judge cannot award a just judgment. Such a judge would not earn the respect and credibility with lawyers and the public.
Indian Laws: Misuse of Power By Indian Judges
News reports in print and media indicate that judges in India are touchy about their reputation and what is reported about them in the media. Constructive criticism is always welcomed by the judges but when they are portrayed unfairly by the press, they are likely to find it oppressive. The fact that many judges misuse their powers has also tarnished the reputation of judges in general. Judicial activists are demanding more transparency and accountability from the judges in India. The demand for scrapping the ‘contempt of court’ provision is gaining momentum with citizens.
