Indian Law: No Law to Curb Illegal Colonies, Says Government

The government of India has not been able to restrict the growth of illegal colonies across the country.

Did you know that there are over 1,639 unauthorized colonies in Delhi? Imagine what the statistics are in other states! The State Government has admitted in an RTI reply that there is no Indian law to restrict the growth of illegal colonies. Further, it has said that the lack of Indian laws pertaining to unauthorized colonies has failed the purpose of planned development. Also, the urban development department said that no legal action has been taken till date against anyone, for the commission of such offence.

Indian Law: Government To Cap the Growth of Illegal Colonies

The Bijwasan MLA, Satprakash Rana, had filed the RTI, that is discussed herein. He pointed out that due to the absence of effective Indian law pertaining to the growth of unauthorized colonies, it is very difficult to cap the growth of such colonies.

He further, said that only those people who purchase illegal properties and start construction are held liable under the Indian property laws but those who sell these properties are set free. Further, Rana said that as mentioned in the RTI reply, the government is planning to establish a committee, which will initiate the formation of an Indian law pertaining to the matter.

Raj Kumar Chuahan, the Urban Development Minister, has confirmed that the State Government is planning to enact a law to restrict the growth of illegal colonies. Also, the Minister said that with increase in the rate of formation of illegal colonies, their number would soon reach 2, 000.

In Delhi, which is also the country’s political power hub, the problem is worsened by the egoistic whims and fancies of other power centers such as top politicians, dignitaries and highly influential people. Unofficially, news reporters hint that nearly every month at least four illegal colonies are constructed with the backing of the top brass. The properties are sold in the form of small plots or houses.

Final Legal Take Away Tip: In the year 1977, the government regularized all the existing unauthorized colonies, in accordance with existing Indian law. Further, in 1994, the State Government prepared a list of 1, 071 unauthorized colonies, in agricultural land, for regularization. What is urgently required is not just the enactment of a law but a more effective way of curbing the growing number of such colonies.
