A city based NGO; Janhit Manch has challenged the validity of astrological predictions. The NGO filed a lawsuit, in Bombay High Court, against the famous astrologer, Bejan Daruwalla and not so famous, Brahmarshi Shri Kumar Swami. The PIL was filed by the NGO’s convener Bhagwanji Raiyani and his associate, Dattaram Kumkar.

The petitioners pointed out that even local train are full of such advertisements. According to the petitioners, these are misleading advertisements that misguide the public. Also, the PIL pointed out several cases of false predictions, such as the appointment of Indira Gandhi and Charan Singh as prime ministers, just to mention a few. .

Also, the petitioners contended that when they had contacted Daruwalla’s office, they were asked to pay Rs.25, 000 for an appointment. They stated that Daruwalla’s personal assistant, Bapu, demanded an extra Rs.3, 000 for an urgent appointment.

However, advocate Advait Sethna, who represented the Union Government, argued that even the apex court has accepted astrology as a science. The counsel pointed out that many Indian Universities offer courses in astrology and that a science that is more than 4, 800 years old science cannot be banned.

The Division Bench comprising of Justices F.I. Rebello and J.H. Bhatia asked questions like how wearing a stone on a finger changes someone’s destiny. However, the Bench admitted that astrology as a stream of science has been accepted by the apex court. The court directed the Union government, the Maharashtra government and the state director-general of police, to file separate affidavits, specifying the number of cases registered by them, under the Drugs and Magic Remedies (Objectionable Advertisements) Act, 1954.

Notices were issued to Daruwalla and Brahmarshi, who were not represented by their lawyers. The notices sought them to file a reply within a period of four weeks.

Final Legal Take Away Tip: An offender under the Drugs and Magic Remedies (Objectionable Advertisements) Act, 1954, shall be punished with an imprisonment up to six months and fine, for first offence. He shall be liable for imprisonment up to one year and fine, for subsequent offences.

Bejan Daruwalla is a fraud. I contacted him through his website and spoke to him. He asked me to pay Rs. 3300 and I deposited the amount in his bank account. Initially he asked me to ask as many questions I wanted and he would answer them. When I sent the amount and email with questions, told me that he would reply in 3 days and then upon receiving his response, I called him again, he again said 6 days and finally replied in just a tiny paragraph after 12 days. He had predicted in a very vague manner with "may" and "can" in every prediction. I called him again and he refused to justify it for me. He has contradicted himself in his predictions because during telephonic conversation he predicted something else and in the email it was just the opposite which he refused to justify. He is a total FRAUD and I request everyone not to fall a prey to his marketing.......he lures people in his advertisements etc....

I completely agree with you. Bejan Daruwalla is really a fraud. I cannot believe that a man of his stature can stoop so low. I contacted him to find out my birth time and he asked me to deposit 3,500 Rs in his HDFC bank account. After that he said he would get back in 5 days. On the 7th day when I wrote to him, he replied in 5-6 lines about shani's influence and what ring i should wear?? He completely ignored my original question and replied something else on his own. If people like Bejan Daruwalla can behave like lowly frauds, what can you expect from the rest. Please stay away from this scam man.
