Indian Law: Supreme Court Warns Justice D.V. Shylendra Kumar
India legal news brings you the latest updates about the controversial open battle that sparked on a serious discord between Justice Kumar and Justice Dinakaran of the Karnataka High Court. The controversy arose, when a Bench of judges headed by Justice Kumar, challenged the administrative authority of Justice Dinakaran.
As earlier reported by India legal news, Justice Kumar has been accused of questioning the administrative decisions of the Chief Justice Dinakaran on various matters. Justice Kumar and the Bench headed by him are reported to have used strong language against the CJ, Justice Dinakaran. Matters took a bitter turn when Justice Kumar challenged the decision of the Chief Justice regarding a tax matter that was to be listed.
Indian Law: Justice Kumar Slammed By the Apex Court
A petition was filed by the Karnataka High Court against Justice Shylendra in the Supreme Court and it was heard by the vacation bench of the Apex Court comprising of justices Deepak Verma and K.S. Radhakrishnan.
The Bench has decided to put a stay on the interim orders passed by the High Court Bench led by Justice Shylendra. The Supreme Court also held that being the Chief Justice of the Karnataka High Court, Justice Dinakaran is the supreme authority to decide on its administrative matters. It was further observed that the conduct of the Bench led by Justice Kumar completely breached the guidelines set by the Supreme Court pertaining to legal matters and judicial discipline.
Keeping in view the gravity of the matter, the Supreme Court also directed the Secretary General of the Supreme Court to bring the matter under the notice of the Chief Justice of India. The Court also directed its registry to communicate the order to the Registrar of the Karnataka High Court via fax and telephone.
