J&K HC to have Native Chief Justice

 India Law News: The Supreme Court collegium of five most senior judges headed by CJI SH Kapadia has recommended Nisar Ahmad Kakru, who hails from Jammu and Kashmir, to be posted as Chief Justice of the Jammu and Kashmir High Court.  

Presently, the Chief Justice of J&K is Aftab Hussain Saikia, who hails from Assam, will be shifted back to the Gauhati High Court. 

According to the current judicial transfer policy, a Chief Justice should be from outside the state. The move therefore is a major shift in the judicial transfer policy of nearly two decades. 
 
Justice Nisar Ahmed Kakru was appointed as chief justice of the Andhra Pradesh High Court in February 2010.
 
The apex court’s move comes at a crucial time when the centre is yet to take a final call on strife-torn Kashmir. The decision adds credence since Prime Minister Manmohan Singh is expected to conduct an all-party meeting on the Kashmir situation and also on the relaxation of the Armed Forces (Special Powers) Act on Wednesday.
