Justice Sarosh Homi Kapadia to Be India's Next CJI
The Supreme Court of India is the country’s highest court of appeal. The Supreme Court was established on 28 January 1950. The composition and jurisdiction of the Supreme Court of India is laid down in Articles 124 to 147 of the Constitution of India. Typically, the Supreme Court comprises of the Chief Justice, (who is referred to with respect as the CJI) and 30 other judges.
Supreme Court of India: Appointment of the New CJI
The Chief Justice of India is appointed by the President of India.
On April 30, 2010, Justice Sarosh Homi Kapadia was appointed as the country’s 38th CJI. Justice Kapadia will be sworn in on May 12, 2010. The Warrant of Appointment which has been signed by President Pratibha Patil has been sent to the Supreme Court registry.
Supreme Court of India: Legal Practice and Judicial Role of Justice Kapadia
Justice Sarosh Homi Kapadia began practice as an advocate at the Bombay High Court. In March 1993, he was appointed as an additional judge of the same High Court and promoted as a permanent judge in 1993. He has also served as the chief justice of Uttarakhand High Court and moved to the Supreme Court bench in 2003.
While serving as a judge in the Bombay High Court, Justice Kapadia decided matters pertaining to:
- Financial matters under RBI and the Banking Regulation Act
- Matters under PIL
- Matters related to Municipalities
- Matters related to Mergers and Acquisitions
- Matters under Income Tax Act
Justice Kapadia's in-depth knowledge and expertise on a wide range of issues, particularly tax laws, has won him tremendous respect and accolades from the Bar and the Bench in equal measure.
