my father owns a 5 acre plot and as we live in a joint family my father gave the power of attorney to my cousin but now she is not living with us as she did a love marriage. My father is afraid of losing the property as her husband might influence her to grab the opportunity. i want to know if my father can change the power of attorney to mmy brothers name without my cousins consent. its important , plzz help.

do we need her signatures for cancellation of POA ??? the another problem is all the property papers are with my uncle who's daughter owns the POA, so can we get duplicate copies from the government or is it necessary to get the original papers????
you have no reason to worry for that......
just ask your father to make cancellation of power of attorney deed...
which will automatically cancel the power of attorney given to your cousin and also to inform her about the change......so that she didnot sale the property to anybody..
also if GPA is made then according to decision by supreme court.... sale of property by GPA is bad in law and it must be SPA instead of GPA
Can she sell that property without my fathers signature ???? the original papers are with her father as he is elder to my father and he is not giving the papers now... so can we get duplicate copies from the government or we need the original once only.
Till the revocation of POA she can sell the property without consent of your father,so your father should immediate cancel the POA and to notice in the newspaper and also inform the concerned party.If she already sold the property without paying the money then your father can file a civil suit- for misuse the POA-----------------------Minansu Bhadra,Advocate
