Protest Against Collegium: Bombay HC Judge Resigns

India Law News: Disgusted on being transferred to Patna, the Bombay High Court judge Justice Rajiv Shyamrao Mohite (53) has reportedly tendered his one page resignation via fax to President Pratibha Patil. What appears to be the first sign of defiance against the Supreme Court collegium headed by CJI SH Kapadia, the sitting judge Justice Mohite has cited “personal reasons” for this act.
His name appeared in the list of 12 High Court judges who were asked to swap positions by the Chief Justice of India, Justice SH Kapadia. LIG has reported the transfers, which are widely believed to be a move by the collegium in “public interest.” Justice Mohite, who was appointed judge of the Bombay High Court in 2001, became one of the youngest judges of the country at the age of 43. Justice Mohite's resignation will be effective after a month.
Mumbai based Mohite has established ample practice in the civil and criminal fields of law. He has announced several landmark judgements on humanitarian and environmental issues, including right to housing of slum dwellers and the right to maintenance of Muslim women. In his formative years, Justice Mohite founded a charitable organization called Legal Aid Society of Bombay.
