Rapists Pay Rs 50K to Escape Prison

Legal News India: The Supreme Court of India released three rapists (accused for gang rape) after each of them agreed to pay the victim a fine of Rs. 50,000. Although the bench comprising Justices Markandeya Katju and Gyan Sudha Mishra endorsed the decision to have the accused convicted, it did not ask for their imprisonment. The SC Bench set the rapists free after observing that they had served three years of their 10-year sentence.

supreme-court-of-indiaThe three rapists had petitioned against their imprisonment, claiming that both, they and their victim, were happily married and “wanted to live peacefully” with their respective spouses.

Senior counsel Kamini Jaiswal reacted against the order saying, “Nobody can buy a woman's dignity. I am appalled by an order given by the Supreme Court — that too by a lady judge.” Expressing shock at the decision of the apex court, Senior advocate Pinky Anand said, “Criminal law does not permit compromises. Compensation is an addition to the punishment. It is not an alternative.”

According to the Indian Penal Code (IPC) provisions, gang rape mandates any punishment between 10 years in jail to life imprisonment.

The court must have looked into the case as also each case is entirely different in relations to other but as far as legal aspect is concern there should not be any compromise as in relation to money aspect or else people will commit crime specially the persons who can afford and as per acccording will pay 50000/- no big issue
