SC Seeks Affidavit on Child Marriage Act Anomalies

Legal News India: The Supreme Court of India has asked the Centre to file an affidavit detailing the anomalies in the laws classifying a girl as ‘minor’ since these hinder the efforts to control child marriage. Additional Solicitor General (ASG) Indira Jaising responded to the apex court’s order by saying that the uniformity of age for all laws is impossible as every law is created with a specific social objective.

child-marriageThe Centre told the SC that it is in favor of proclaiming child marriage as illegal although in many cases, the court has supported child marriage. The government further informed that child marriage, although an offence, is ‘valid’. The minor has to be able to reject her marriage by approaching a court for child marriages to be held as illegal.
