SC Suspends Ayodhya Title Ruling

India Legal News: In what appears to be a landmark judgment in making, the Supreme Court has given ‘stay’ order to the judgment on the ‘Ram Janm Bhoomi/Babri Masjid’ land dispute pronounced by the Allahabad High Court last year, September 30. The SC ordered a status quo on the disputed structure and contended that verdict of an equal distribution of the ancient disputed land between three contenders could be safely termed ‘something strange’ because no party actually prayed for a land partition.
A bench of justices comprising of Aftab Alam and RM Lodha reiterated that no religious activity should take place in the 67 acre of land and also mentioned that the order of status quo should be maintained in relation to the entire area. In December’s ruling the Allahabad court ordered that the Ayodhya land to be split between the Hindus, Muslims and a one of the early hindu minority sect called Nirmohi Akhara.
The bench also added that the verdict of dividing the religious land has thrown ‘open a litany of litigation’ It was hearing various appeals, namely Nirmohi Akhara, Sunni Central Wakf Board, Bhagwan Ram Virajman, Akhil Bharat Hindu Mahasabha and Jamait Ulama-I-Hind.
The claimants of the land the Hindu group distinctively claim that the site is the birthplace of Lord Rama, whereas the Muslim group argue that the verdict was not based on evidence and facts concerning the history of the site.
Hindus claim the site of the Babri Masjid is the birthplace of their deity, Ram, and want to build a temple there. Muslim groups have argued that the Allahabad court's ruling appeared to be based not on evidence but on the professed beliefs of Hindus.
